Terms and Conditions

1. Acceptance of terms

By downloading, installing, creating an account for, or otherwise using SafetyCheck, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of the Service

SafetyCheck sends you a daily (or custom-interval) "Are you OK?" notification. You confirm you're safe with a single tap. If you do not respond, the app sends up to three gentle reminder notifications. If you still have not responded after all reminders, SafetyCheck automatically contacts the emergency contact(s) you've designated by SMS text message and an automated phone call, and shares your last known GPS location with them.

Available features vary by plan (Free, Basic, or Pro), including the number of emergency contacts, check-in frequency options, check-in history retention, and — on Pro — smartwatch health monitoring and monthly safety reports. Current plan details and pricing are listed on our Pricing page and are incorporated into these Terms.

3. Eligibility and accounts

• You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create a SafetyCheck account.
• You must provide accurate, current information when registering, including a valid phone number and at least one emergency contact.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must promptly update your account if your emergency contact's information changes, and keep the app's location and notification permissions enabled — the Service cannot function correctly without them.

4. Your emergency contacts

You represent that you have obtained permission from each person you designate as an emergency contact to (a) provide their name and phone number to us, and (b) have them contacted by automated SMS and phone call, including receipt of your location, in the event of a missed check-in. You are solely responsible for choosing emergency contacts who are willing and able to respond, and for keeping their contact information accurate. SafetyCheck is not responsible for an emergency contact's failure or inability to respond.

5. Subscriptions, pricing, and billing

• Free: $0 — one emergency contact, a fixed 24-hour check-in interval, SMS and voice alerts, and location sharing.
• Basic: $5.99/month or $59.99/year — everything in Free, plus 12 months of check-in history, custom check-in frequency (1–168 hours), and up to 3 emergency contacts.
• Pro (coming soon): $9.99/month or $99.99/year — everything in Basic, plus Apple Watch and Wear OS support, health monitoring, monthly safety reports, and live GPS.

Paid subscriptions are billed through the Apple App Store or Google Play and are subject to their respective payment terms. Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before renewal. You can manage or cancel your subscription at any time through your App Store or Google Play account settings. Refunds are handled by Apple or Google in accordance with their respective refund policies — SafetyCheck does not directly process payments or issue refunds. We may change pricing for future billing periods with advance notice.

6. Permissions and device requirements

SafetyCheck requires certain device permissions to function, including location access and push notifications, and — for smartwatch features — a paired and connected Apple Watch or Wear OS device. The Service depends on your device having power, a network or cellular connection, and correctly configured notification settings. SafetyCheck cannot send check-in prompts, receive your responses, or alert your emergency contact if your device is off, out of battery, in airplane mode, lacks connectivity, or has notifications/location disabled or restricted by the operating system.

7. Acceptable use

You agree not to:

• provide false emergency contact information or impersonate another person;
• use the Service to harass, threaten, or repeatedly contact someone who has not consented to being an emergency contact;
• attempt to reverse-engineer, decompile, or interfere with the Service's normal operation;
• use the Service for any unlawful purpose or in violation of any applicable law.

8. Disclaimers and limitations on the Service

SafetyCheck is a wellness check-in tool, not an emergency response, medical, or monitoring service. In particular:

• Not a 911 replacement. SafetyCheck does not contact police, fire, medical responders, or any emergency dispatch service. It only contacts the personal emergency contact(s) you designate.
• No guaranteed delivery or response. Notifications, SMS messages, and automated phone calls depend on third-party carriers, push notification services, and your emergency contact's own device and availability. We do not guarantee that any alert will be delivered, seen, heard, or acted upon.
• Location accuracy. GPS location shared during an alert reflects your device's last known location at the time it was recorded, which may be delayed, inaccurate, or unavailable (for example, indoors or in areas with poor signal).
• No monitoring by SafetyCheck. We do not actively monitor check-ins in real time and do not take any action ourselves when a check-in is missed — the Service's role is limited to automatically notifying your designated emergency contact.
• Health data (Pro). Heart rate and SpO2 readings are provided by your smartwatch's sensors and manufacturer software. SafetyCheck does not independently verify their accuracy and does not provide medical advice, diagnosis, or treatment. Health monitoring features are not a medical device.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SAP FACTORY, LLC AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF LIFE, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE — INCLUDING A MISSED, DELAYED, OR FAILED CHECK-IN NOTIFICATION, ALERT, OR LOCATION SHARE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT SUCH LIABILITY CANNOT BE FULLY DISCLAIMED UNDER APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify and hold harmless SAP Factory, LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any rights of a third party, including an emergency contact you designate without their permission.

11. Intellectual property

The Service, including the SafetyCheck name, logo, app, and website, is owned by SAP Factory, LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use in accordance with these Terms. All other rights are reserved.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, or if we discontinue the Service, with notice where reasonably practicable. Upon termination, the disclaimers, limitations of liability, and indemnification provisions in these Terms will continue to apply.

13. Governing law and disputes

These Terms are governed by the laws of the State of Maryland, USA, without regard to its conflict of laws principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Maryland, and you consent to personal jurisdiction there, except where applicable law requires otherwise.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app notice before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
