Privacy Policy

1. Who we are

SafetyCheck is a personal safety mobile application (the "App," "Service") available for iOS, Android, and compatible smartwatch platforms, operated by SAP Factory, LLC ("SafetyCheck," "we," "us," or "our"), a Maryland limited liability company located at 306 W Redwood St Ste 201, Baltimore, MD 21201, USA.

This Privacy Policy applies to the SafetyCheck mobile app, our website at mysafetycheck.app, and any related services (collectively, the "Service"). It should be read alongside our Terms and Conditions.

2. Information we collect

We collect the following categories of information:

a. Information you provide directly

• Account information: name, email address, phone number, and password (or sign-in credentials if you use a third-party sign-in).
• Emergency contact information: the name and phone number of each person you designate as an emergency contact (up to 1 contact on Free, up to 3 on Basic).
• Check-in preferences: your chosen check-in schedule (fixed 24-hour interval on Free; configurable 1–168 hours on Basic and Pro), reminder settings, and time zone.
• Payment and subscription information: if you subscribe to Basic or Pro, payment is handled by the Apple App Store, Google Play, or our subscription-management partner, RevenueCat. We do not receive or store your full card number.
• Support communications: anything you send to [email protected] or through in-app support.
• Health data (Pro tier, optional): if you enable Apple Watch or Wear OS health monitoring on the Pro plan, we process heart rate and blood-oxygen (SpO2) readings from your paired device solely to support check-in and alerting features. This data is processed with your explicit opt-in and is never sold or used for advertising.

b. Information collected automatically

• Check-in activity: timestamps of check-in prompts sent, your responses (or lack of response), and any resulting alerts.
• Device and push tokens: device type, operating system version, and push-notification tokens (via Apple Push Notification service and Firebase Cloud Messaging) needed to deliver check-in prompts and reminders.
• Usage data: general app usage and diagnostic/crash information used to keep the Service reliable.

3. Location data

SafetyCheck periodically records your device's GPS location so that, if an alert is triggered, we can share your last known location with your emergency contact. Location is:

• collected only while the app has the location permission you've granted on your device;
• used internally to power the check-in and alerting features described in these policies;
• shared externally only with your designated emergency contact, and only after an alert is triggered (see Section 5);
• never sold, and never used for advertising or profiling.

You can disable location permissions at any time in your device settings, but doing so will prevent SafetyCheck from sharing your location during an alert, which is a core part of how the Service works.

4. Your emergency contact's information

When you add an emergency contact, you are providing us with that person's name and phone number. You are responsible for having their permission to share this information with us and to have them contacted by SMS and phone call on your behalf if you miss a check-in. Your emergency contact does not need to install the app or create an account — they simply receive messages and calls if triggered. If you are an emergency contact and want your information removed, contact [email protected] and we will honor that request, subject to the app user's ability to designate a replacement contact.

5. How we use your information

We use the information described above to:

• send you daily (or custom-interval) "Are you OK?" check-in notifications;
• send up to three gentle reminder notifications if you don't respond;
• automatically notify your emergency contact by SMS and phone call — including your last known GPS location — if you don't respond after all reminders have been sent;
• maintain your check-in history (Basic and Pro tiers, retained for 12 months);
• generate optional monthly safety reports (Pro tier);
• process subscription payments and manage your plan;
• provide customer support and respond to your requests;
• maintain, secure, and improve the Service, including diagnosing technical issues;
• comply with legal obligations.

We do not use your check-in, location, or health data for advertising, and we do not sell personal information.

6. How we share information

We share information only in the following circumstances:

• With your emergency contact(s): your name and last known location, communicated by SMS and an automated phone call, solely when an alert is triggered by a missed check-in.
• With service providers who process data on our behalf under contract, as described in Section 7.
• For legal reasons: if required by law, subpoena, or legal process, or to protect the rights, property, or safety of SafetyCheck, our users, or the public.
• Business transfers: if SAP Factory, LLC is involved in a merger, acquisition, or sale of assets, your information may be transferred, subject to this Policy.
• With your consent: for any other purpose disclosed to you at the time you provide the information.

7. Third-party service providers

We rely on the following categories of infrastructure and service providers to operate SafetyCheck. Each processes only the data necessary to perform its function.

These providers are contractually restricted from using your information for any purpose other than providing services to SafetyCheck.

8. SMS and phone call communications

By designating a phone number as an emergency contact, you represent that you have that person's consent to receive SMS text messages and an automated phone call from SafetyCheck (via Twilio) in the event of a missed check-in. Message and data rates may apply to your emergency contact. Full details on our messaging program, including opt-out instructions, are available on our SMS Terms page.

9. Data retention

• Account information is retained for as long as your account is active.
• Check-in history is retained per your plan (not retained beyond the current check-in cycle on Free; 12 months on Basic and Pro).
• Location data used to power an alert is retained only as long as needed to complete that alert and for a limited period afterward for support and safety-review purposes, then deleted or anonymized.
• If you delete your account, we delete or anonymize your personal information within 30 days, except where we are required to retain it to comply with law, resolve disputes, or enforce our agreements.

10. Security

We use industry-standard technical and organizational measures — including encryption in transit, access controls, and secure hosting — to protect your information. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify you as required by applicable law.

11. Your rights and choices

Depending on your location, you may have the right to:

• access, correct, or delete the personal information we hold about you;
• withdraw consent to location tracking (via your device settings) or to health-data processing (via app settings);
• export your data;
• opt out of non-essential communications;
• delete your account entirely, in-app or by emailing [email protected].

We will respond to verified requests within the timeframe required by applicable law.

12. California and other U.S. state privacy rights

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended, gives you the right to know what personal information we collect, request deletion, correct inaccurate information, and opt out of the "sale" or "sharing" of personal information. We do not sell or share personal information for cross-context behavioral advertising. Residents of other U.S. states with comprehensive privacy laws (e.g., Virginia, Colorado, Connecticut) have similar rights, which we honor on request to [email protected].

13. International users

SafetyCheck is operated from the United States, and information is processed and stored in the United States. If you access the Service from outside the U.S., you understand that your information will be transferred to, stored, and processed in the U.S. or other countries where our service providers operate. If you are located in the European Economic Area, United Kingdom, or Switzerland, you may have additional rights under the GDPR or UK GDPR, including the right to lodge a complaint with your local data protection authority; contact us and we will work with you to honor those rights.

14. Children's privacy

SafetyCheck is not directed to, and is not intended for use by, children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, contact [email protected] and we will delete it.

15. Changes to this policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or through an in-app notice before the changes take effect. The "Last updated" date at the top of this page reflects the most recent revision.
